In breach of international law: Ukrainian drug legislation and the European Convention for the Protection of Human Rights and Fundamental Freedoms

Ukrainian Ministry of Health Resolution No. 634 dated 29 July 2010 brought into force amendments that significantly reduce the legal threshold for “small,” “large” and “extra large” quantities of certain types of illegal drugs, including those most commonly used by people who use drugs in Ukraine.

According to the laws of Ukraine, regulatory acts issued by the ministries should conform to the European Convention for the Protection of Human Rights and Fundamental Freedoms, the practice of the European Court, and international treaties to which Ukraine is a signatory.

Our analysis of Resolution No. 634 indicates that it does not conform to the European Convention or the practice of the European Court, and so should be repealed in favour of a human rights-based and public health-oriented approach.
